How are paper patent files handled in reexamination proceedings?
For patents not available on the Image File Wrapper (IFW) system, paper patent files are handled as follows in reexamination proceedings:
- The movement of paper patent files is monitored by the PALM system.
- If a patent file is only available in paper form, it should be ordered and scanned into the IFW.
- This scanning process ensures access throughout the prosecution of the reexamination proceeding.
MPEP 2635 states:
“If the patent file is in paper form, the paper file should be ordered and scanned into the Image File Wrapper (IFW) for access throughout the prosecution of the reexamination proceeding.”
