What is a Statement of Grant of Protection in international design applications?
A Statement of Grant of Protection is a formal notification sent by the United States Patent and Trademark Office (USPTO) to the International Bureau of the World Intellectual Property Organization (WIPO) after a patent is issued on an international design application designating the United States. This statement confirms that protection has been granted for the industrial design(s) covered by the patent.
As stated in MPEP 2940:
“Upon issuance of a patent on a nonprovisional international design application, the Office will send to the International Bureau a statement that protection is granted in the United States to the industrial design or designs that are the subject of the international registration and covered by the patent.”
This process is governed by 37 CFR 1.1068 and serves to notify the public and third parties about the granted protection through publication in the International Designs Bulletin.
