This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.

The time limits for responding to a requirement for information are specified in MPEP 704.14(a):

Quote: “The examiner should set a reasonable time limit (e.g., one month or thirty days) for reply to the requirement for information… The time limit set to reply to a requirement for information is not extendable under 37 CFR 1.136(a) or (b). See MPEP § 2258(f).”

In summary:

  • The examiner typically sets a one-month or 30-day deadline.
  • This deadline is not extendable under standard extension provisions.
  • Applicants should respond promptly to avoid potential abandonment of their application.
