The MPEP 905.03(b) outlines the general procedure for identifying appropriate groups for classification in the Cooperative Patent Classification (CPC) system:

  1. Identify appropriate subclasses:
    • Review subclass titles for scope coverage
    • Consult subclass notes, references, and definitions
    • Repeat until a suitable subclass is verified
  2. Identify appropriate group(s):
    • Identify candidate main groups
    • Verify notes, references, and definitions don’t exclude the subject matter
    • Ensure the group is in active use
  3. Select the most appropriate group:
    • Choose the group that most completely covers the invention
    • Follow special rules like Last Place Priority Rule (LPPR) or First Place Priority Rule (FPPR) when applicable
    • Consult scheme notes and definitions for special classification rules
  4. Consider application/functional classification places
  5. Identify genus/species classification places
  6. Use residual classification places if necessary

The MPEP emphasizes: “Whenever classifying into a group, the scheme should always be consulted for precedence notes and references that indicate a preference for classification in another group.”
