What are the criteria for an application to be made special based on applicant’s age or health?
An application can be made special based on the applicant’s age or health under certain conditions. According to MPEP 708.01:
- Age: The applicant must be 65 years of age or older.
- Health: The applicant must provide evidence of a serious illness.
The MPEP states: A petition to make an application special on the ground of applicant’s age or health must be accompanied by evidence showing that the applicant is 65 years of age, or more, or a statement that the applicant’s health is such that he or she might not be available to assist in the prosecution of the application if it were to run its normal course, such as a doctor’s certificate or other medical certificate.
