How should examiners handle models or exhibits too large to be brought to the USPTO?

For models or exhibits that are too large to be brought to the USPTO, examiners should follow these guidelines:

  • The examiner may make an on-site inspection of the model or exhibit.
  • A video presentation of the model or exhibit can be submitted.
  • Photographs can be submitted in lieu of the actual model or exhibit.

As stated in MPEP 713.08: “In situations where a model or exhibit is too large to be brought to the Office, the examiner should, if necessary to obtain a complete understanding of the invention, conduct an on-site inspection or view a video presentation or photographs of the model or exhibit.”
