Can the public access the same patent classification information as patent examiners?
This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
Yes, the public can access much of the same patent classification information as patent examiners. According to MPEP 902.03(b):
“Examiners and the public are provided with access to identical information for the Index, schedules, and definitions.”
While some tools, like the Patent Classification Retrieval System (PCRS), are specifically for internal use, the public can access similar information through:
- The USPTO Patent Classification Home Page (www.uspto.gov/Classification)
- The USPTO Patent Full-Text and Image Database
- EAST and WEST tools available in the Patent Search Room at the USPTO
This ensures transparency and allows inventors, attorneys, and researchers to access comprehensive classification data for their patent searches and research.
