What is required when a sequence is presented in a patent drawing?
When a sequence is presented in a patent drawing, there are specific requirements that must be followed. According to MPEP 2412.06:
“When a sequence is presented in a drawing, the sequence must still be included in the ‘Sequence Listing XML’ if the sequence falls within the definition set forth in 37 CFR 1.831(b), and a sequence identifier (‘SEQ ID NO:X’ or the like) must be used, either in the drawing itself or in the Brief Description of the Drawings.”
To comply with this requirement:
- Include the sequence in the Sequence Listing XML if it meets the definition in 37 CFR 1.831(b)
- Assign a sequence identifier (e.g., ‘SEQ ID NO:X’) to the sequence
- Include the sequence identifier either in the drawing or in the Brief Description of the Drawings
This ensures that all sequences are properly cataloged and can be easily referenced, regardless of where they appear in the patent application.
