This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.

Only registered patent practitioners can represent a patent owner in a supplemental examination proceeding. The MPEP 2804 states:

“A patent owner may not be represented during a supplemental examination proceeding or any resulting ex parte reexamination proceeding by an attorney or other person who is not registered to practice before the Office.”

This means that the representative must be either a registered patent attorney or a registered patent agent.
