What information is included in a Statement of Grant of Protection?
A Statement of Grant of Protection for an international design application contains specific information as outlined in the Manual of Patent Examining Procedure (MPEP) 2940. According to Hague Rule 18bis(1)(b), the statement must include:
- The Office making the statement (in this case, the USPTO)
- The number of the international registration
- Which industrial designs are covered by the statement (if not all)
- The date on which the international registration produced or shall produce the effect as a grant of protection under the applicable law
- The date of the statement
Additionally, if any amendments were made during the examination process, the statement should also contain or indicate these amendments as per Hague Rule 18bis(1)(c):
“Where the international registration was amended in a procedure before the Office, the statement shall also contain or indicate all amendments.”
This comprehensive information ensures that the International Bureau and the public are fully informed about the scope and details of the granted protection for the industrial design(s) in the United States.
