What are the requirements for the request form in a PCT application?

The request form in a PCT application must meet specific requirements as outlined in MPEP 1821. These include:

  • The request must be made on a standardized form (PCT/RO/101) or be presented as a computer printout complying with the Administrative Instructions.
  • The form must be in the language of publication of the international application.
  • The request must be signed.

As stated in the MPEP, “The request must contain the following indications:

  • (i) a petition for the international application to be processed according to the PCT;
  • (ii) the designation of at least one Contracting State;
  • (iii) the name of and other prescribed data concerning the applicant and the agent (if any);
  • (iv) the title of the invention;
  • (v) the name of and other prescribed data concerning the inventor where required by any designated State;
  • (vi) where applicable, a priority claim;
  • (vii) a reference to any earlier international, international-type, or other search; and
  • (viii) the signature of the applicant or agent.”

These requirements ensure that the PCT application is properly filed and can be processed according to international standards.
