Can I file a PCT application without using the standard request form?

While it is strongly recommended to use the standard PCT request form (PCT/RO/101), there is some flexibility in how the request can be presented. According to MPEP 1821:

“The request must be made on a standardized form (Form PCT/RO/101) or be presented as a computer printout complying with the Administrative Instructions. A file copy of the request form is not required. Irrespective of whether the request is made on the printed form or as a computer printout, it must always be presented as one of the component parts of the international application.”

This means that while you can use a computer printout instead of the standard form, it must comply with the Administrative Instructions and contain all the required information. The key points to remember are:

  • The request must be in the language of publication of the international application.
  • It must contain all the required indications and be signed.
  • If not using the standard form, ensure your computer printout fully complies with the Administrative Instructions.

To avoid potential issues or delays in processing, it’s generally safer and more straightforward to use the official PCT/RO/101 form provided by WIPO.
