What are the translation requirements for entering the U.S. national stage?

The translation requirements for entering the U.S. national stage are as follows:

1. If the international application was not filed in English and was not published under PCT Article 21(2) in English, a translation of the application into English is required.

2. For international applications with a filing date on or after July 1, 2022:

“An English translation is required for any sequence listing in XML format (“Sequence Listing XML”) containing non-English language values for any language-dependent free text qualifiers in accordance with 37 CFR 1.831 through 1.834.” (37 CFR 1.495(c))

3. For international applications with a filing date before July 1, 2022:

“A sequence listing need not be translated if the sequence listing complies with PCT Rule 12.1(d) and the description complies with PCT Rule 5.2(b).” (37 CFR 1.495(c))

4. The translation must be a complete and accurate translation of the international application as filed, including any changes accepted under PCT Rules 26 or 91.

5. A processing fee is required for accepting a translation after 30 months from the priority date.

Failure to provide a timely and proper translation may result in the application being held abandoned.
