This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.

To participate in a Patent Prosecution Highway (PPH) program, you need to submit a request to the Director of International Patent Legal Administration. As stated in MPEP 1002.02(p):

“Requests for participation in a Patent Prosecution Highway program (www.uspto.gov/patents/init_events/pph/index.jsp).”

To participate in the PPH program:

  • Ensure your application meets the eligibility requirements for the specific PPH program
  • Prepare and submit the necessary PPH request form and supporting documents
  • Provide a claims correspondence table showing how the claims in your U.S. application correspond to the allowable/patentable claims in the Office of Earlier Examination (OEE) application
  • Submit any required translations of documents

For detailed information and current requirements, visit the USPTO’s Patent Prosecution Highway page. The USPTO will review your request and determine whether your application qualifies for the PPH program based on the specific requirements and agreements with foreign patent offices.
