How are reissue patents classified in the MPEP?
According to MPEP 901.04, reissue patents are classified as follows:
“Reissue patents are given a new patent number and are classified in the same way as are the original patents.”
This means that reissue patents:
- Receive a new patent number distinct from the original patent
- Are classified using the same system as the original patents
- Maintain their original classification in terms of utility, design, or plant patents
It’s important to note that while reissue patents get new numbers, they retain the classification of their original counterparts, ensuring consistency in patent organization and search processes.
