Note:
The Director will issue a certificate of extension for the patent term if no request for reconsideration is filed within one month. The period of extension is calculated based on the FDA's regulatory review period.

Length of Patent Term Extension Determined by Regulatory Review Period
Note:
The length of patent term extension is determined by the regulatory review period as set by the Secretary of Health and Human Services or Agriculture, with appropriate reductions.

The procedure for calculating the length of the patent term extension is set forth for human drugs, antibiotic drugs, and human biological products in 37 CFR 1.775; for food or color additives in 37 CFR 1.776; for medical devices in 37 CFR 1.777; for animal drug products in 37 CFR 1.778; and for veterinary biological products in 37 CFR 1.779. The length of patent term extension is the length of the regulatory review period as determined by the Secretary of Health and Human Services or the Secretary of Agriculture, but reduced, where appropriate, by the time periods provided in 37 CFR 1.775 – 1.779. Office Relies on Secretary’s Determination for PTE Calculation
Note:
The Office will use the Secretary's determination of the regulatory review period to calculate the patent term extension under 37 CFR 1.775-1.779.

Extension Period Cannot Exceed Two Years for Pre-1984 Patents
Note:
The calculated extension period for patents issued before September 24, 1984, cannot exceed two years if the product was commercially marketed or used after this date.

For products other than animal drug or veterinary biological products, the calculated extension period cannot exceed any of the following statutory maximum periods of extension:

(D) If the patent involved was issued before September 24, 1984, (the date of enactment of the statute), and the regulatory review period proceeding started before this date, and the commercial marketing or use of the product has been approved after such date, the calculated period of extension may not exceed two years.

Note:
If a patent issued before November 16, 1988, and the regulatory review period started before this date, the extension period cannot exceed three years after commercial approval.

Note:
The Office determines the length of patent term extension after reviewing regulatory agency information and applying statutory provisions.

Note:
A certificate of patent term extension will not be issued if the patent's term cannot be extended, even if other conditions for extension are met.

Extension of Patent Term Including Adjustments and Disclaimers
Note:
This rule extends a patent’s term by including any adjustments under former 35 U.S.C. 154(b) for applications filed between June 8, 1995, and May 28, 2000, and any adjustments under 35 U.S.C. 154(b) for later filings, while considering terminal disclaimers.

A patent term extension generally extends the patent from its “original expiration date,” as defined by 35 U.S.C. 154 to include extension under former 35 U.S.C. 154(b) (for applications filed between June 8, 1995 and May 28, 2000) and patent term adjustment under 35 U.S.C. 154(b) (for applications filed on or after May 29, 2000), and in view of any applicable terminal disclaimer.
