According to MPEP 2683, the steps for filing an appeal to the Federal Circuit in an inter partes reexamination are:

  1. In the USPTO, timely file a written notice of appeal directed to the Director in accordance with 37 CFR 1.302 and 1.304.
  2. In the Federal Circuit, file a copy of the notice of appeal and pay the required fee.
  3. Serve a copy of the notice of appeal on every other party in the reexamination proceeding.

The MPEP states: “A patent owner or a third party requester appellant must take the following steps in such an appeal to the Federal Circuit (37 CFR 1.983(b)):” followed by the steps outlined above.
