This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
When a proper corrected request is timely filed for supplemental examination, it establishes the filing date for the supplemental examination request. The MPEP states, “If a proper corrected request is timely filed, the filing date of the supplemental examination request will be the receipt date of the corrected request. The Office will mail a Notice of Supplemental Examination Request Filing Date to the patent owner.” This notice confirms the official filing date of the supplemental examination request.
