How should applicant and inventor names be formatted in the Sequence Listing XML?

According to WIPO Standard ST.26 and the MPEP, applicant and inventor names in the Sequence Listing XML should be formatted as follows:

  • The applicant’s name must be indicated in the ApplicantName element, generally in the language of the application filing.
  • The inventor’s name may optionally be indicated in the InventorName element.
  • Both elements must include a languageCode attribute as specified in WIPO Standard ST.26, paragraph 9 (referencing ISO 639-1:2002).
  • If the applicant’s name contains non-Latin characters, a transliteration or translation in Latin characters must be provided in the ApplicantNameLatin element.
  • For inventor names with non-Latin characters, a Latin alphabet transliteration or translation may be optionally provided in the InventorNameLatin element.

The MPEP states: Where the applicant name indicated contains characters other than those of the Latin alphabet permitted as described in reproduced in MPEP § 2413.01(a) item (2), a transliteration or translation of the applicant name must also be indicated in characters of the Latin alphabet in the element ApplicantNameLatin.
