What are the options for translating foreign language patents at the USPTO?

The USPTO provides several options for translating foreign language patents. According to MPEP 901.05(d):

  • Translations Service Center: The USPTO maintains this center to assist examiners with translations.
  • Commercial Services: Examiners can use commercial translation services when necessary.
  • Machine Translations: While not always accurate, these can provide a general understanding of the content.
  • INPADOC Family Documents: English language equivalents within the same patent family can serve as unofficial translations.

The MPEP advises: “If an English-language equivalent document is not available, the examiner should have the foreign language document translated.” This ensures that examiners have a thorough understanding of potentially relevant prior art.
