What can an examiner do if they believe an application has improper CPC classifications?

If an assigned examiner believes that an application has one or more improper Cooperative Patent Classification (CPC) symbols, they have the option to submit a classification challenge. This process allows for the correction of CPC designations to ensure accurate classification and appropriate assignment of the application.

According to MPEP 909.01(a):

“When a new application is received which, in the opinion of the assigned examiner, has one or more improper C* classifications on the application, the assigned examiner may submit a classification challenge to have a C* designation added and/or a C* designation removed.”

This procedure helps maintain the integrity of the classification system and ensures that applications are reviewed by examiners with the most relevant expertise. For more details on the classification challenge process, examiners can refer to MPEP § 909.01(d).
