How do extensions of time affect the statutory period for reply?
Extensions of time can be granted to extend the statutory period for reply to an Office action. According to MPEP 710.01(a):
If the period for reply is extended, the time extended is added to the last calendar day of the original period, as opposed to being added to the day it would have been due when said last day is a Saturday, Sunday, or federal holiday.
For example, if a 1-month extension is granted for a reply originally due on April 30, the new due date would be May 31, regardless of whether April 30 falls on a weekend or holiday. Extensions of time are available under 37 CFR 1.136(a), and applicants must submit the proper fee for any extension.
