How should examiners handle the modification of Form Paragraphs?

Examiners are instructed to avoid modifying Form Paragraphs unnecessarily. The MPEP 707 states:

“Examiners should no longer modify the language of form paragraphs by making minor changes to the wording. If the form paragraph does not require the specific change to the language being made by the examiner, a new form paragraph should be developed and approved as provided in subsection I above.”

This guidance emphasizes the importance of maintaining consistency in office actions. If an examiner needs to make significant changes to a Form Paragraph, they should:

  • Develop a new Form Paragraph
  • Submit it for approval
  • Use the approved new Form Paragraph in future office actions

This process ensures that all Form Paragraphs used in patent examinations are standardized and approved.
