What are the conditions for withdrawal from accelerated examination?

An applicant can withdraw from the accelerated examination program at any time during the examination process. However, there are specific conditions and consequences to consider:

  • The application will be removed from the accelerated examination program and placed on the examiner’s regular docket.
  • The application will no longer be accorded special status.
  • The applicant cannot rescind the request to withdraw.
  • Any request to withdraw from the accelerated examination program must be submitted electronically.

According to MPEP 708.02(a): “To withdraw from the accelerated examination program, applicant should file a petition for withdrawal from special status under 37 CFR 1.102 (preferably electronically via EFS-Web).”

It’s important to note that once withdrawn, the application cannot be reinstated into the accelerated examination program.
