This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.

A Notice of Allowability (form PTOL-37) should include specific information related to the allowance of the patent application. According to MPEP 1302.03:

“The date of any communication and/or interview which resulted in the allowance should be included in the notice.”

Based on this guidance, a Notice of Allowability typically includes:

  • The application number and filing date
  • The name(s) of the applicant(s)
  • The examiner’s name and art unit
  • The title of the invention
  • The allowed claims
  • Any examiner’s amendments or reasons for allowance
  • The date of any communication or interview that led to the allowance
  • Any required fees or other administrative matters

This comprehensive information ensures that both the applicant and the USPTO have a clear record of the allowance decision and its basis.
