Requests for republication of a patent application are handled by the Director of Office of Data Management. As stated in MPEP 1002.02(r), these requests are governed by “37 CFR 1.221(a), MPEP § 1130.”
To request republication:
- Submit a request in writing to the USPTO
- Clearly state the reasons for republication
- Pay the required fee
- Ensure your request complies with all requirements outlined in 37 CFR 1.221(a)
Common reasons for republication include material errors in the published application or the addition of previously omitted material. It’s important to review MPEP § 1130 for detailed guidance on the republication process.
