What statements are required when submitting a Sequence Listing?

When submitting a Sequence Listing for a patent application, several statements are required according to MPEP 2427:
- A statement that the “Sequence Listing” includes no new matter
- A statement that indicates support for the amendment in the application, as filed
- A statement that the content of the CRF is identical to the “Sequence Listing” part of the disclosure
These statements are crucial for ensuring compliance with 37 CFR 1.821-1.825. For example, 37 CFR 1.825(b)(5) requires “A statement that the ‘Sequence Listing’ added by amendment includes no new matter.” Failure to provide these statements can result in non-compliance and may require correction by the applicant.
