What ownership documentation is required for a supplemental examination request?
This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
When filing a request for supplemental examination, the patent owner must provide specific ownership documentation. According to MPEP 2803: “A request for supplemental examination must include an identification of the owner(s) of the entire right, title, and interest in the patent requested to be examined, and a submission by the patent owner in compliance with 37 CFR 3.73(c) establishing the entirety of the ownership in the patent requested to be examined.” This requirement ensures that all parties with ownership interest are bound by any changes resulting from the supplemental examination process.
