This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.

If an amendment after allowance is not entered, the examiner will notify the applicant using form PTOL-271 or PTO-271. As stated in MPEP 1303.01:

“If the amendment is not entered, the examiner will notify the applicant by using form PTOL-271 or PTO-271.”

This notification informs the applicant that their amendment was not accepted and provides an opportunity for the applicant to take appropriate action, such as filing a continuation application or requesting reconsideration.
