Certain documents are not permitted to be filed by facsimile transmission in international patent applications. The MPEP section 1834.01 clearly states:

“It should be noted that a facsimile transmission of a document is not permitted and, if submitted, will not be accorded a date of receipt if the document is:

  • (A) Required by statute to be certified;
  • (B) A color drawing submitted under 37 CFR 1.437;
  • (C) An international application for patent; or
  • (D) A copy of the international application and the basic national fee necessary to enter the national stage, as specified in 37 CFR 1.495(b).”

These restrictions are in place to ensure the integrity and proper processing of critical documents in the international patent application process.
