This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.

When a reexamination request is transferred between Technology Centers (TCs), all relevant documents must be included. According to MPEP 2237:

“If a request for reexamination is submitted to the incorrect TC, the TC should retain a copy of the request papers in the TC and forward the original request papers to the appropriate TC.”

The documents included in the transfer typically consist of:

  • The original reexamination request papers
  • Any filing fee receipts
  • Any additional correspondence or documents submitted with the request

It’s important to note that the TC receiving the transferred request should process these documents as if they were originally submitted to that TC, ensuring continuity in the reexamination process.
