What are the time limits for filing a notice of appeal in inter partes reexamination?

The time limits for filing a notice of appeal in inter partes reexamination are specified in MPEP 2674. The manual states:

The time for filing a notice of appeal is within thirty days after the mailing of the action from which the appeal was taken. The time for filing a notice of cross appeal is:

  • (A) within fourteen days of service of a party’s original notice of appeal, or
  • (B) within thirty days after the mailing of the action from which the appeal was taken, whichever is later.”

It’s important to note that these time limits are strictly enforced. Failure to file a notice of appeal within the specified timeframe may result in the loss of appeal rights. Extensions of time are not available for filing a notice of appeal in inter partes reexamination proceedings.
