What are the size limitations for submitting a “Sequence Listing XML” file electronically?
When submitting a “Sequence Listing XML” file electronically via the USPTO patent electronic filing system, there is a specific size limitation. According to MPEP 2413.03:
“For submission of a “Sequence Listing XML” that is 100MB in size or less, the preferred method of submission is via the USPTO Patent Electronic System. Only the Patent Center system of the USPTO Patent Electronic System is capable of accepting .xml files.”
This means that:
- The maximum file size for electronic submission is 100 MB.
- Files larger than 100 MB must be submitted on read-only optical discs.
- File compression is not permitted for electronic submissions.
It’s important to note that if your “Sequence Listing XML” file exceeds 100 MB, you’ll need to use the physical media submission option instead of electronic filing.
