This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
The size limitations for a computer program listing appendix depend on the submission method:
- For electronic submissions via EFS-Web or Patent Center: The file size must not exceed 25 MB.
- For compact disc submissions: There is no specific size limitation, but multiple discs may be used if necessary.
According to MPEP 608.05(a): “Computer program listings may be submitted as ASCII text files via EFS-Web or on compact disc, provided the size of the file does not exceed 25 megabytes.” For larger files, the MPEP advises: “If the file size of the computer program listing appendix exceeds 25 megabytes, the applicant must submit the program listing appendix on compact disc.”
