What are the requirements for supplemental reissue oaths or declarations?

Supplemental reissue oaths or declarations may be required in certain circumstances during the reissue application process. According to MPEP 1414:

“A supplemental reissue oath or declaration must be filed in a reissue application to correct any deficiencies or errors in the initial reissue oath or declaration.”

Requirements for supplemental reissue oaths or declarations include:

  • Identifying any deficiencies or errors in the original oath or declaration.
  • Providing the corrected information or statements.
  • Being signed by the inventor(s) or the assignee of the entire interest.
  • Complying with all other requirements for reissue oaths or declarations as outlined in MPEP 1414.

Supplemental oaths or declarations are also required when the reissue application is being broadened after the original filing, or when new errors are being corrected that were not addressed in the original oath or declaration.
