What are the possible responses an examiner might receive after submitting a file request through FOS?
After submitting a file request through the File Ordering System (FOS), an examiner may receive one of the following responses:
- The request is accepted.
- The request is accepted, but the file is located at a remote warehouse (resulting in increased delivery time).
- The request is not accepted because the file is not located at the repository or warehouse.
- The request is not accepted because a previous request for the file has not yet been filled.
- The request is not accepted because the patent or application number inputted is not valid.
The MPEP specifies: After transmission of the request transaction by the examiner, a “response” screen appears which informs the examiner of the status of the request for each file.
This response system helps examiners understand the status of their file requests and any potential delays or issues.
