What are the filing date requirements for an international design application?
The filing date requirements for an international design application are outlined in MPEP 2906. The International Bureau will accord a filing date to an application that meets the following criteria:
- The application is in one of the prescribed languages (English, French, or Spanish)
- It includes an indication that international registration under the Hague Agreement is sought
- It contains sufficient information to identify the applicant
- It provides contact information for the applicant or representative
- It includes a reproduction or specimen of each industrial design
- It designates at least one Contracting Party
As stated in the MPEP, “Pursuant to Rule 14(2), the International Bureau will accord the international design application a filing date only if the application is in one of the prescribed languages. The prescribed languages, set forth in Hague Agreement Rule 6, are English, French, and Spanish.“
