This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
The submission requirements for biological sequence listings in patent applications depend on the filing date of the application:
- For applications filed before July 1, 2022: Submit a “Sequence Listing” as an ASCII plain text file in compliance with 37 CFR 1.821 – 1.824.
- For applications filed on or after July 1, 2022: Submit a “Sequence Listing XML” as an XML file in compliance with 37 CFR 1.831 – 1.834.
In both cases, the sequence listing can be submitted via the USPTO patent electronic filing system or on read-only optical discs. These requirements ensure proper handling and standardization of biological sequence information in patent applications.
