To amend ASCII plain text file submissions (e.g., Sequence Listings, Large Tables, or Computer Program Listing Appendices):
- Submit a replacement ASCII plain text file
- Include a request to incorporate the replacement file by reference
- Provide a statement identifying the location of all changes
- Include a statement that the replacement file contains no new matter
- For read-only optical disc submissions, provide replacement discs labeled as “REPLACEMENT MM/DD/YYYY”
As stated in MPEP 608.05: Any amendment to the information on a read-only optical disc must be by way of a replacement read-only optical disc, in compliance with 37 CFR 1.58(g) for “Large Tables”, 37 CFR 1.96(c)(5) for a “Computer Program Listing Appendix”, and 37 CFR 1.825(b) for a “Sequence Listing” or a CRF of a “Sequence Listing”, and 37 CFR 1.835(b) for a “Sequence Listing XML”.
