How long does the early publication process take?

This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
According to MPEP 1129, “The publication process takes approximately 14 weeks and does not begin until the application is complete and ready for publication (e.g., an executed oath or declaration has been filed and the filing fee has been paid).”
It’s important to note that the 14-week timeline is an approximation, and the actual time may vary. The USPTO will publish the application as soon as possible if it is otherwise ready for publication, but they do not consider requests for publication on specific dates.
