How does the USPTO handle partial changes in ownership recorded in the International Register?
The USPTO has specific rules regarding partial changes in ownership recorded in the International Register. According to MPEP 2930 and 37 CFR 1.1065(b):
“A recording of a partial change in ownership in the International Register pursuant to Rule 21(7) concerning a transfer of less than all designs shall not have effect in the United States.”
This means that if only some designs in an international registration are transferred to a new owner, the USPTO will not recognize this partial change. However, this does not limit the right of the owner to assign or transfer a portion of their interest in the application, or to record such a transfer with the USPTO. It only means that the recording of such a transfer in the International Register will not automatically have effect in the United States.
