How can minor errors in Sequence Listing compliance be handled?
This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
According to MPEP 2427, minor errors in Sequence Listing compliance can be handled efficiently to expedite the processing of applications. The MPEP states:
“In order to expedite the processing of applications, minor errors pertaining to compliance with the sequence rules discovered after examination has begun may be handled with the next Office action.”
Examples of minor errors that can be addressed in this manner include:
- Missing sequence identifiers in the specification or drawings
- Missing or incomplete incorporation by reference of the “Sequence Listing” in the specification
- Missing statement that the sequence information in the “Sequence Listing” is identical to the CRF
The examiner may include objections to these minor errors along with other substantive issues in the next Office action. This approach allows for efficient processing while still ensuring compliance with sequence listing requirements.
