How can I pay the fee for an ex parte reexamination request?
This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
The fee for an ex parte reexamination request can be paid through various methods accepted by the USPTO. According to MPEP 2215:
“The fee for requesting ex parte reexamination may be paid by deposit account authorization, credit card, or electronic funds transfer (EFT) payment methods. Hereinafter the credit card and EFT payment methods are referred to as the Revenue Accounting and Management (RAM) payment method.”
To pay the fee:
- Use the USPTO’s Fee Payment System for online payments
- Include a completed Form PTO-2038 for credit card payments
- Provide deposit account information for deposit account payments
Ensure that the payment is made in the full amount required for your entity size (large, small, or micro) to avoid potential issues with your reexamination request.
