How are corrections handled in pending nonprovisional international design applications?
This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
The USPTO handles corrections in pending nonprovisional international design applications on a case-by-case basis. According to MPEP 2930:
“The effects of any correction in the International Register by the International Bureau pursuant to Rule 22 in a pending nonprovisional international design application shall be decided by the Office in accordance with the merits of each situation, subject to such other requirements as may be imposed.”
When a Rule 22 correction is received, the USPTO will determine whether to give effect to the correction or refuse its effects. If the correction is entered and affects data in the official filing receipt, a corrected filing receipt will be issued.
