How are applicants indicated in a PCT demand for international preliminary examination?
The MPEP 1864.02 provides guidance on how applicants should be indicated in a PCT demand for international preliminary examination:
- Only applicants for the elected States are required to be indicated in the Demand.
- The required information for each applicant includes name, address, telephone number, facsimile machine number, nationality, and residence.
- These requirements are the same as those for the Request under PCT Rule 4.
- Inventors who are not also applicants are not indicated in the Demand.
The MPEP states: “The detailed requirements for the various indications required in connection with each applicant (name and address, telephone number, facsimile machine number, nationality and residence) are the same as those required under PCT Rule 4 in connection with the Request.“
It’s important to note that if a change in the name or person has been requested under PCT Rule 92bis.1 before the Demand was filed, the applicant(s) of record at the time of filing the Demand should be indicated.
