What is the purpose of the sequence rules in patent applications?
This page is an FAQ based on guidance from the Manual of Patent Examining Procedure. It is provided as guidance, with links to the ground truth sources. This is information only: it is not legal advice.
The sequence rules in patent applications serve several important purposes, as explained in MPEP 2412.01:
“The sequence rules […] set forth a standardized format for describing nucleotide and amino acid sequences in patent applications. This standardized format allows for the presentation of such sequences in a clear and unambiguous manner and in a form that is searchable by computer algorithms.”
The main purposes of the sequence rules are:
- To ensure clarity and unambiguity in the presentation of biological sequences
- To facilitate computer-based searches of sequence information
- To standardize the format of sequence disclosures across all patent applications
- To enable efficient examination and comparison of sequences by patent examiners
- To create a uniform system for sequence information in the global patent system
By adhering to these rules, applicants contribute to a more efficient and effective patent examination process, particularly in the field of biotechnology.
