What is the purpose of restriction requirements in patent applications?

Restriction requirements in patent applications serve several important purposes:

  • To ensure efficient examination of patent applications
  • To prevent a single application from covering multiple distinct inventions
  • To manage the workload of patent examiners

According to MPEP 808, restriction requirements are justified when:

Every requirement to restrict has two aspects: (A) the reasons (as distinguished from the mere statement of conclusion) why each invention as claimed is either independent or distinct from the other(s); and (B) the reasons why there would be a serious search and/or examination burden on the examiner if restriction is not required

By requiring applicants to focus on a single invention or a group of related inventions in each application, the patent office can maintain the quality and efficiency of the examination process while ensuring that each distinct invention receives proper scrutiny.
