What are the size limits for electronic submissions in patent applications?

The USPTO has established size limits for electronic submissions in patent applications:

  • For “Large Tables” and “Computer Program Listing Appendix” files submitted via the USPTO patent electronic filing system, there is a 25 MB size limit per file. File compression is not permitted for these submissions.
  • For “Sequence Listing” or “Sequence Listing XML” files, there is a 100 MB size limit when submitted via the USPTO patent electronic filing system.

As stated in the MPEP, “If a user submits an electronic copy of a file that exceeds these size limits on a read-only optical disc(s), it is recommended that the read-only optical disc(s) be submitted via Priority Mail Express® from the USPS in accordance with 37 CFR 1.10, or hand delivery, on the date of the corresponding USPTO patent electronic filing system filing.”

These size limits ensure efficient processing of electronic submissions while allowing for the submission of large data sets when necessary.
