How is the transmittal fee for an international design application determined?

The transmittal fee for an international design application filed through the USPTO as an office of indirect filing is determined based on the entity status of the applicant. According to MPEP 2910:

“The transmittal fee is discounted for small and micro entities. Payment, by any party, of the exact amount of the small entity transmittal fee set forth in 37 CFR 1.1031(a) will be treated as a written assertion of entitlement to small entity status.”

The fees are as follows:

  • Micro entity: $30.00
  • Small entity: $60.00
  • Other than small or micro entity: $120.00

It’s important to note that the transmittal fee must be paid in U.S. dollars and is required for the USPTO to transmit the application to the International Bureau.
