To update or correct the name of the applicant in a nonprovisional international design application, you need to:

  1. Submit a corrected Application Data Sheet (ADS) under 37 CFR 1.76
  2. Specify the correct or updated name of the applicant in the applicant information section
  3. Identify the information being changed with underlining for insertions and strike-through or brackets for text removed

MPEP 2920.02 states: “Any request to correct or update the name of the applicant under 37 CFR 1.46 must include a corrected ADS under 37 CFR 1.76 specifying the correct or updated name of the applicant in the applicant information section.

Additionally, for international registrations, a name change recorded with the International Bureau may be effective: “A change in the name of the applicant under 37 CFR 1.46 recorded pursuant to Hague Agreement Article 16(1)(ii) may also be effective to change the name of the applicant in a nonprovisional international design application.” This recording must be made no later than the payment of the issue fee.
